TERMS OF SERVICE

1. Our Service

Eligibility

This is a contract between you and Neurodeck. You must read and agree to these terms before using the Service. You may use the Service only if you can form a binding contract with Neurodeck, and only in compliance with this Agreement and all applicable laws. Any use or access to the Service by anyone under 16 is strictly prohibited.

User Accounts & Security

Your account gives you access to the services and functionality we establish. If you open an account on behalf of a company, you represent that you have the authority to bind the entity to this Agreement. You are responsible for the activity that occurs on your account and must keep your credentials secure.

Acceptable Use

You agree not to engage in any of the following prohibited activities:

• Use the Service in any way that violates any applicable law or regulation.
• Transmit any harmful, threatening, abusive, or objectionable content.
• Attempt to gain unauthorized access to the Service or related systems (hacking).
• Interfere with or disrupt the Service or servers (DDoS, load testing without permission).
• Use the Service to send spam or unsolicited communications.
• Impersonate any person or entity or misrepresent your affiliation.

2. User Content

You retain ownership of your User Content, but you grant Neurodeck a license to use, store, and process it to provide the Service. You represent and warrant that:

• You have all necessary rights to your User Content.
• Your User Content does not violate any law or infringe third-party rights.
• Your User Content does not contain viruses or malicious code.

3. Intellectual Property

Except for your User Content, the Service and all materials therein (software, text, graphics, logos) are the exclusive property of Neurodeck. You may not sell, license, modify, or create derivative works from any Neurodeck Content without our express written permission.

We care about your privacy. By using the Service, you consent to our Privacy Policy. While we use commercially reasonable security measures, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures.

8. Indemnification

You agree to defend, indemnify and hold harmless Neurodeck from any claims, damages, or expenses arising from:

• Your use of the Service.
• Your violation of this Agreement.
• Your violation of any third-party rights or applicable laws.

9. Disclaimers & Liability

Disclaimer of Warranties:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". Neurodeck does not warrant that the Service will meet your requirements, be uninterrupted, secure, or error-free.

Limitation of Liability:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEURODECK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO NEURODECK IN THE PAST 12 MONTHS.

11. Termination

You may terminate your account at any time. Neurodeck may terminate or suspend your access to the Service at any time, with or without cause. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

This Agreement shall be governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
